Your information. Your rights. Our responsibilities.
This Notice of Privacy Practices describes how medical information about you may be used and disclosed by StatePharm Rx and how you can get access to this information. Please review it carefully. This Notice applies to protected health information (PHI) created or received by our pharmacy in connection with dispensing medications, counseling, refill coordination, and related health care operations. Our website Privacy Policy covers general website and account data that is not PHI.
Our duties
We are required by law to: • Maintain the privacy and security of your PHI. • Provide you with this Notice of our legal duties and privacy practices. • Follow the terms of the Notice that is currently in effect. • Notify you if a breach occurs that may have compromised the privacy or security of your PHI, as required by law.
How we may use and disclose your PHI
We may use and disclose your PHI for: Treatment. We may use and share your PHI to provide, coordinate, or manage your pharmacy care. For example, we may communicate with your prescriber about a prescription, compound a medication ordered for you, or counsel you or your caregiver about how to use a medication. Payment. We may use and share PHI to bill and collect payment from you, an insurer, or another responsible party, and to determine eligibility or coverage. Health care operations. We may use and share PHI for quality assessment, staff training, accreditation, licensing, audits, business planning, and customer service related to our pharmacy operations. We may also disclose PHI as permitted or required by law, including: • To public health authorities for reporting related to disease, injury, or medication safety when required. • For health oversight activities such as audits, investigations, and inspections. • In response to a court order, subpoena, or other lawful process. • To law enforcement in limited circumstances allowed by law. • To avert a serious threat to health or safety. • For workers’ compensation or similar programs as authorized by law. • To business associates who perform services for us under a written agreement that requires them to protect PHI. Uses and disclosures that generally require written authorization include most uses of PHI for marketing that is not face-to-face or that involves financial remuneration as defined by HIPAA, and the sale of PHI. You may revoke an authorization in writing except to the extent we have already acted in reliance on it.
Your rights regarding your PHI
You have the right to: • Inspect and obtain a copy of PHI we maintain about you in a designated record set, with limited exceptions. • Request an amendment if you believe information is incorrect or incomplete. We may deny the request in certain cases and will tell you why in writing. • Request an accounting of certain disclosures of your PHI. • Request restrictions on certain uses or disclosures. We are not required to agree to every request, except we must agree to a restriction on disclosure to a health plan for an item or service you paid for in full out of pocket, when required by law. • Request confidential communications (for example, that we contact you at an alternative address or phone number). • Receive a paper copy of this Notice upon request, even if you agreed to receive it electronically. • File a complaint if you believe your privacy rights have been violated (see below). You will not be retaliated against for filing a complaint.

Changes to this Notice
We reserve the right to change the terms of this Notice and to make the new provisions effective for all PHI we maintain. The revised Notice will be posted on our website and available upon request. The effective date appears at the top of this page.
