Terms of Use
Rules for using the StatePharm Rx website and online services.

1. Agreement to these Terms
By accessing or using statepharmrx.com or related online portals and forms (the "Site"), you agree to these Terms of Use ("Terms"). If you do not agree, do not use the Site. These Terms govern use of the Site only. They do not replace prescription requirements, pharmacist counseling, provider agreements, or other contracts that may apply to pharmacy services.
2. Who may use the Site
You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account or submit forms on your own behalf. Parents, guardians, or authorized caregivers may use certain features for a patient when permitted by law and our policies. Provider portal access is limited to licensed or otherwise authorized healthcare professionals who complete our registration and verification process and whose access we approve.
3. Informational content, not medical advice
Content on the Site, including Insights articles, product category pages, and educational materials, is for general information only. It is not medical advice, a diagnosis, or a substitute for consultation with a licensed healthcare professional. Compounded and other medications are dispensed only pursuant to a valid prescription from a licensed prescriber, where legally permitted. Always follow the directions on your prescription label and ask your pharmacist or prescriber if you have questions.
4. Prescriptions and compounding
StatePharm Rx is a compounding pharmacy that prepares patient-specific medications under applicable federal and state law (including 503A framework requirements as applicable). Availability of any therapy depends on a valid prescription, clinical appropriateness, formulary and inventory, and legal restrictions. Nothing on the Site is an offer to sell a prescription drug without a valid prescription. See our 503A Compounding Disclosure for additional information.
5. Accounts and security
If you create an account, you are responsible for maintaining the confidentiality of your credentials and for activity under your account. Notify us promptly at info@statepharmrx.com if you suspect unauthorized access. We may suspend or terminate access for suspected misuse, security risk, inaccurate registration information, or violation of these Terms.
6. Acceptable use
You agree not to: • Use the Site for any unlawful purpose. • Attempt to gain unauthorized access to systems, accounts, or data. • Interfere with Site security, rate limits, or availability. • Submit false, misleading, or fraudulent information. • Scrape, harvest, or automate access in a way that burdens our systems without permission. • Upload malware or harmful code. • Use the Site to harass others or violate privacy or intellectual property rights.
7. Forms and communications
Contact forms, refill requests, and similar tools help us respond to you. Submitting a form does not guarantee that a prescription will be filled, shipped, or approved. We may need additional information from you or your prescriber. Electronic communications may include email and, if you opt in, SMS. Message and data rates may apply for SMS. You may opt out of marketing messages as described in those messages or by contacting us.
8. Intellectual property
The Site and its content, branding, logos, and design are owned by StatePharm Rx or its licensors and are protected by intellectual property laws. You may view and print materials for personal, non-commercial use related to evaluating or using our services. You may not copy, modify, distribute, or create derivative works without our prior written consent, except as allowed by law.
9. Third-party services
The Site may integrate or link to third-party services (for example, maps, hosting, or email). We are not responsible for third-party sites or services. Your use of them may be subject to their terms and privacy policies.
10. Disclaimer of warranties
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, STATEPHARM RX AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100) OR THE AMOUNT YOU PAID US (IF ANY) FOR SITE ACCESS IN THE TWELVE MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER. Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law. This section does not limit liability that cannot be limited for pharmacy professional services where prohibited.
12. Indemnity
You agree to defend, indemnify, and hold harmless StatePharm Rx and its personnel from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site, your violation of these Terms, or your violation of any law or third-party right.
13. Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Exclusive venue for disputes arising from these Terms or the Site shall be the state or federal courts located in Fort Bend County or Harris County, Texas, unless applicable law requires otherwise. Before filing a claim, you agree to contact us at info@statepharmrx.com and attempt to resolve the dispute informally for at least 30 days.
14. Changes
We may update these Terms by posting a revised version on the Site with an updated effective date. Continued use after changes become effective constitutes acceptance of the revised Terms.
